Refund Policy

Effective date: 1st October 22, 2020

This Dragon Fish Refund Policy (the “Policy”) outlines our policies and procedures regarding refunds for the podcast production and distribution services purchased through the website https://DragonFishPM.com (the “Services”). This Policy is an integral part of our Terms of Service (the “Terms”) and is incorporated by reference therein. The Policy and the Terms should be read and interpreted in conjunction. The capitalized terms used but not defined in this Policy have the meanings attributed to them in the Terms.

Our commitment

We strive to provide the Services of the best quality. We also respect consumer rights and comply with the applicable consumer protection laws, such as Ontario Consumer Protection Act 2002. If you would like to cancel the Services for any reason, please read this Policy carefully. Your statutory rights will not be affected by the Policy.

Cancelling the Services

If, at any time, you no longer wish to use the Services and your Subscription, you may cancel your Subscription and keep all posted podcasts. We guarantee that you will be able to use any remaining podcast credits until you choose to cancel your Account. To cancel the Subscription, please login to your Account and click on “Cancel Subscription” in your dashboard. Your Subscription will be cancelled immediately.

Consumers (“cooling-off” period)

If you conclude a service contract as a consumer (i.e., an individual acting wholly or mainly outside your trade, business, craft or profession), you are entitled to withdraw from your service contract with us within the period of 14 days after the service contract was concluded (e.g., the date you purchased the Subscription). In order to terminate your contract on this basis and receive a refund, you must inform us of your decision to withdraw from the service contract in writing by email at h@DragonFishPM.com within the period of 14 days.

If you have used the Services prior to communicating your request to cancel the contract, we reserve the right to charge you proportionally for the time period for which you have used the Services and return you the Fees for the unused time period only for which you have paid.

We will refund money within 15 days by using the same payment method that you used to make the payment, unless you have expressly requested otherwise. In any case, you will not incur any fees as a result of a refund.
If you decide to cancel your Subscription after the period of 14 days expires, no refunds will be issued, unless stated otherwise in this Policy or the Terms.

Third-party intellectual property

Some of the intellectual property assets, such as the Submitted Content and third-party trademarks, featured on Dragon Fish may be owned by the users of Dragon Fish and other third parties. Such third-party intellectual property does not belong to the Company and it remains the sole property of the respective third-party proprietors.

Non-consumers

If you conclude your contract for the Services as a business, trader, or for professional purposes, notwithstanding Section 7 of the Terms, you are not entitled to a refund of the Fees paid by you, if you withdraw from the contract or cancel your Subscription. If there is an unauthorized use of Dragon Fish through your Account or if you are unsatisfied with the quality of the Services, please contact us immediately.

Refunds for erroneous podcasts

We may provide refunds, at our sole discretion, for the Services that where not completed by us properly. For example, if a podcast was not disseminated due to a lack of due diligence or an oversight from our side, we will refund the Fees for such podcast. However, please note that no refunds are issued if the Services were not completed properly due to the errors made by you in the Submitted Materials, acts and omissions of our third-party service providers, and other events outside of our reasonable control, such as:

  • If you did not follow our guidelines and instructions;
  • If you did provide us with information about the proper pronunciation of your brands, products, and items;
  • If you did not comply with the Terms; or
  • If you did not provide us with other information necessary for successful completion of the Services.
No guarantee

We do not guarantee that the distribution outlets with which we cooperate will pick up the podcast as such pick-ups are at sole discretion of the distribution outlets. Once we send the podcast out, the distribution outlets decide whether to publish the podcast or not. The results of the pick-ups and dissemination of the podcast depend on various factors, including but not limited to, the topic, content, length, interest, and other specifics of your podcast.
